What do you think of Bolivia's recent "Law of Mother Earth" (http://positivenews.org.uk/2011/peace_democracy/justice/4377/bolivia-to-give-legal-rights-to-the-earth/)? I think it is an interesting idea, in theory. But, who decides what the Earth's rights are? Answer: the people in power. Therefore I think this idea carries a great danger of becoming a tool which the state uses to exert control over individuals.

If you read into it, the charter would basically require 1st world countries to pay for everything that would be required to make it viable.

It is a cyclical argument. It would take a tremenous amount of resources to shift the infrastructure of even the smallest country into a carbon-neutral one while maintaining even a modicum of modern life. The resources would not be, by themselves, carbon nuetral.
